Consultancy in the Management of Entrepreneurial Conflicts

Usually companies may face conflicts not only with their clients or services providers, but also among its corporate partners, with employees or among employees.

 

Your company may go to CeCAP and request advice on management of conflicts through our programs or to organize training on the subject for your conflict management department.

 

Criminal Conciliation and Mediation

Criminal Conciliation and Mediation according to the new Penal Procedural Code may be exercised by Private Conciliation and Mediation Centers. In this sense, article 201 provides that the following offences may be withdrawn and hence be subject of conciliation and/or mediation:

  • Manslaughter, personal injuries and negligent injuries
  • Theft, misappropriation, swindling and other frauds, usurpation, damages and offences with check.
  • Non-compliance with Family Duties and libidinous acts when the victim is of age
  • Evasion of payments or undue withholding, provided it does not affect assets of the State
  • Against intellectual property that does not cause damage to public health
  • Libel and slander
  • Inviolability of the home and inviolability of the secret
  • Forgery of documents against individuals

In general, these offences imply an economic compensation for the victim, and by virtue of this they can be withdrawn.

In year 2010 CeCAP was selected through a bid, to develop the International Public Consultancy for the development and implementation of the conflict resolution system in criminal matters, for the Attorney General’s Office, in light of the coming into effect of the new Code.

After 8 months of work, the consultancy was completed with a great level of satisfaction from our counterpart, the Attorney General’s Office; hence, CECAP is the institution with a high qualification to advice your company in the management of these conflicts.
