Reglamento de CeCAP en línea

The Arbitration and Conciliation Center of Panama (CeCAP, for its acronym in Spanish) once again innovates in its services as administrators of arbitration and conciliation proceedings, by offering exclusively to lawyers, arbitrators and secretaries its new ONLINE CECAP service.

ONLINE CECAP is a virtual service that will allow you to inquiry the arbitration and conciliation dockets, allowing you to print folios over the Internet, with total technological security, easily and avoiding travel, by means of a personal and non-transferable code generated by the Center.

In virtue of the above, it presents the USER REGULATIONS.

 

USER’S REGULATIONS

FIRST CHAPTER

GENERAL PROVISIONS

Article 1. ONLINE CECAP is a free service for users of the Center that starts from the moment you are assigned with your Username and Password and until the arbitration award or its clarification is entered.

Article 2. For the operation and solution of the system, CeCAP will designate the necessary personnel, who will be responsible for the digitalization of the dockets. The Arbitration General Secretariat will be in charge of this staff.

Article 3. ONLINE CECAP, is an instrument based on an electronic platform that has been designed to make inquiries of the arbitration and conciliation dockets, allowing the printing of folios through the Internet, with total technological security.

Article 4º. ONLINE CECAP has a series of remote computer resources for the external inquiry of any user through the website www.cecap.com.pa

SECOND CHAPTER

The users

Article 5.- The ONLINE CECAP User is understood as:

  1. Legal representatives of the parties or attorneys duly accredited as representatives in the file.
  2. The arbitrators who have accepted the position.
  3. The secretaries of each arbitral tribunal.
  4. The experts during the period of taking of evidences, prior authorization from the arbitral tribunal.
  5. Personnel assigned to the Arbitration General Secretariat of CeCAP and who have authorization to access it.

Article 6. For the use of the ONLINE CECAP, the user will be assigned a USERNAME and an IDENTIFICATION PASSWORD.

Due to the confidentiality of the arbitration proceedings, the account granted by CeCAP is personal and non-transferable, and under no circumstances can it be lent or shared with third parties.

Article 7. Once the password has been assigned, and for greater security, the user can change it to access the system. However, ONLINE CeCAP’s technological platform will keep a confidential internal control of the use of the system by each user.

Article 8. ONLINE CECAP’s users must comply with the provisions contained in these regulations, and are bound to them from the moment they receive their username and password.

THIRD CHAPTER. ONLINE CECAP’S Operation

Article 9º.- The resources provided by ONLINE CECAP according to the provisions in this regulation are the following:

  1. The infrastructure and information that ONLINE CECAP provides its USERS is of exclusive nature while an arbitration proceedings’ docket is being processed in CeCAP, that is until the entering of the award or clarifications thereof by the arbitral tribunal.
  2. The documents digitized as part of the docket that are posted with the access of ONLINE CECAP, do not replace the authentications and certifications of the Arbitration General Secretariat or the Secretary of the Tribunal in its case.
  3. None of the resources shall be used for the transmission of information to a third party must nor it should be used to receive or send offensive material, or perform acts of defamation.
  4. No ONLINE CECAP user is authorized to grant access to third parties.
  5. The transfer of information accessed through ONLINE CECAP, which affects the confidentiality of the parties to the process.

Article 10. For the optimal development of ONLINE CECAP, the Secretaries of the Arbitral Tribunals shall have the following obligations:

  1. Notify the Arbitration General Secretariat, by means of a form the number of folios of the docket, filed by the parties, received and numbered, so they are included in the docket, for its corresponding digitalization
  2. Number the documents that are going to be entered in the docket the day in which are stamped as received by the Secretary.
  3. Except for the previous sub-paragraph, the documents that exceed 400 pages, which will take up to 3 days to number them from the date on which they were presented by the parties; and those that exceed 1000 pages, in which case, the Secretary will have a maximum of 5 days to number them.

Article 11. The Arbitration General Secretariat will enter and number the documents that are part of the docket in the pre-arbitral stage (before the Tribunal is constituted) and during the arbitration stage, only the documents representing certificates of notification; having said Secretariat, the obligation to fill out the form the number of pages of the docket, filed, received and numbered, in order for them to be included in the docket for its corresponding digitalization.

Article 12.  The usernames and passwords created in ONLINE CECAP will have a finite duration and is determined by the following rules:

  1. That the user requests its termination.
  2. For infractions to this regulation.
  3. For the termination of an arbitration or conciliation process administered by the CeCAP.
  4. By ceasing their functions within the process.

CHAPTER FOUR

Of Infractions

Article 13. The users are authorized to use the resources only for purposes for which CECAP ONLINE is developed, that is, inquiry of dockets in the course of an arbitration or conciliation proceedings; so the failure to comply with the provisions contained in this regulation will constitute an infraction that will be sanctioned with a reprimand or temporary or definitive suspension of the service; without this precluding CeCAP from initiating disciplinary sanctions or for  lack of ethics, or legal actions; as well as legal actions of the affected parties.

 

 

CHAPTER FIVE

EXEMPT FROM RESPONSIBILITY

Article 14. Given that CECAP ONLINE is a support or helping instrument, provided free of charge to users, CeCAP may suspend temporarily or permanently the CECAP ONLINE service, for reasons that justify such an act, and without any liability for it.
